1. Our responsibility
1.1 We will not sell your information to any third parties.
1.2 We will never pass your personal details on to anyone else except where we have your consent; we are permitted to do so by law; to other companies who provide a service to us to enable this service to be fulfilled; and to any successor in title to our business.
1.3 We have a strict anti-spam policy (see paragraph 2) which means the content sent will be relevant and what we feel would benefit you, the customer.
1.4 We are solely responsible for the content sent (see paragraph 3)
1.5 It is our responsibility as data controllers to ensure that all data processed through The SMS system comply with all the GDPR regulations.
1.6 We have a legitimate interest in sending you this marketing: to promote our products and services to our customers and to make sure you are aware of the best offers and deals available
1.7 SMS will not be sent before 8am and after 9pm
1.8 We will ensure that we are compliant up to date with TCPA policies
1.9 We will maintain and keep record of a do not contact list which will be honoured for 5 years
2. Anti-spam policy
2.1 In accordance with the General Data Protection Regulations (GDPR) Cash Inn Ltd has a strict anti-spam policy. This means that we do not allow unsolicited SMS text messages, notifications or alerts.
2.2 Cash Inn Ltd promotes permission-based SMS marketing and has several controls in place to ensure customers compliant with GDPR. We encourage our employees to develop better relationships with their customers by sending useful and appropriate SMS text messages which they feel will benefit the customer.
2.3 In accordance with the FCA SMS text messages are also used to educate customers on money lending and relending, being fair, clear and not misleading. “we think customers would benefit from prompts to enable them to fully understand the proposition they are entering into, and to stop and think about whether applying for further borrowing is right for them. We expect firms to take action to ensure marketing material is more balanced. 3. Responsibility of content
3.1 We are solely responsible for the content of the text messages sent to customers. Several measures are put in place to ensure that content is relevant, professional and ethical.
3.2 We will not use SMS for any improper, immoral, fraudulent or unlawful purposes or for the sending of any communication or storing of any information which is offensive, abusive, indecent, obscene or menacing nature.
4. Your responsibilities
4.1 By registering with Cash Inn Ltd, you warrant that you understand the terms and conditions of this beneficial subscription.
4.2 By registering with us you confirm that your name and number are both information that is correct.
4.3 You acknowledge that if we suspect that registration information supplied is inaccurate or false, we may suspend providing any further service to you.
4.4 It is your responsibility to inform us and update any information that changes (i.e. name and number)
4.5 You agree that, in order to unsubscribe/opt-out from this SMS subscription, you need to do so via this link http://www.sto.pm/cashinn/ or by coming in store. Without this as a reference, you will not be unsubscribed. Replying to the text message will not work.
5. Our Liability
5.1 We are not responsible for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data or any indirect losses which happen as a side effect of the main loss or damage.
5.2 We are not liable for any charges you obtain through receiving texts from us.
5.3 This does not include or limit in any way our liability:
For death or personal injury caused by our negligence;
Under section 2(3) of the Consumer Protection Act 1987;
For fraud or fraudulent misrepresentation; or
For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
6.1 If you breach these Terms & Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies later or in any other situation where you breach these Terms & Conditions.
6.2 Any complaints must be made via phone, Email or in writing, from then reasonable steps will be taken to solve the complaint as quickly and reasonably as possible.
6.3 These Terms & Conditions are subject to English Law. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take further action and take it to court proceedings, you must do so in England, Scotland, Wales or Northern Ireland.
6.4. We shall not be responsible for any breach of these Terms & Conditions caused by circumstances beyond our reasonable control.
6.5 You can Opt-out at any time, to do this please follow the steps in paragraph 4.5, allow 5 working days for this to be done.
6.6 Our ambition is to provide you (the customer) with benefits including shop updates, promotions and offers, prompts and vouchers.
6.7 We will send no more than 3 messages per month (28 days).
6.8 The first message you receive will be confirming you have Opt-in.
6.9 Your information will be safely stored.
